Trading Standards Reveal 80% of Shops Fail Test Purchases on Corrosives
For nearly two decades, Serve Legal has worked alongside nationwide retailers to support businesses in improving their compliance with age verification laws. While many people immediately think of Challenge 25 policies for alcohol, tobacco, knives, or lottery tickets, the scope of age-restricted purchases extends far beyond these products. Items such as solvents, corrosives, and analgesics are also subject to stringent restrictions, though they are often overlooked in the broader conversation about compliance.
A recent Trading Standards operation in Gloucestershire highlights why policing these sales is just as critical. Over the course of the operation, 10 shops were visited by underage volunteers attempting to purchase products containing corrosive substances. Shockingly, eight of these stores sold such items without conducting age checks or requesting identification.
The products sold included items like brick and patio cleaner, plughole unblocker, and caustic soda drain unblocker—all of which contain dangerous chemicals that can pose serious risks if misused.
Legal Implications for Retailers
Under the Offensive Weapons Act 2019, selling products with a high concentration of corrosive chemicals to individuals under 18 is a criminal offense. Retailers found in violation of these laws risk formal action, including prosecution, if they fail to address compliance shortcomings after being warned.
Following the operation, Gloucestershire Trading Standards announced that they would contact the businesses that failed the tests to provide advice on their legal obligations. However, they made it clear that repeated violations would result in stricter consequences.
The Broader Responsibility
For businesses, ensuring the safe sale of age-restricted products is a matter of both compliance and public safety.
An investment into independent third-party auditing services, such as those offered by Serve Legal, can make the difference between a successful or unsuccessful Trading Standards assessment. By proactively engaging experts in compliance checks, businesses can demonstrate their commitment to due diligence and responsible retail practices. This not only reduces the risk of legal repercussions but also builds trust with customers and regulators alike.
Serve Legal has extensive experience working with nationwide hardware and craft stores, supporting their staff in ensuring compliant sales of age-restricted products such as bladed articles and corrosives.
